By using this website, submitting an enquiry, completing an eligibility form, booking a consultation or using our services, you agree to these Terms & Conditions.

If you do not agree with these Terms, please do not use this website or book a consultation.

1. Website Information Is Not Medical Advice

The information on this website is provided for general informational purposes only.

It does not constitute medical advice, diagnosis, treatment or a recommendation that any particular service is suitable for you.

2. Eligibility To Use Our Services

3. Patient Responsibilities

You are responsible for providing accurate and complete information about your health, including your medical history, symptoms, medications, allergies, lifestyle factors, previous treatments and any other information relevant to your care.

You must promptly tell BioVantage or your treating healthcare professional if your circumstances change.

BioVantage and its healthcare professionals rely on the information you provide when assessing your suitability for care.

If you provide incorrect, incomplete or misleading information, this may affect the safety, suitability or quality of the services provided to you.

4. Clinical Assessment And Practitioner Discretion

All clinical decisions are made by registered healthcare professionals based on your individual health history, clinical needs and professional assessment.

A healthcare professional may determine that BioVantage’s services are not appropriate for you.

A healthcare professional may also recommend that you speak with your regular GP, attend an in-person appointment, undertake further testing, seek specialist care or attend urgent medical care.

BioVantage respects the independent clinical judgment of its healthcare professionals.

5. No Guarantee Of Treatment Or Prescription

Completing an initial eligibility form, submitting a booking request, paying a fee, or attending a telehealth consultation does not guarantee that you will be prescribed medication, approved for treatment, or provided with ongoing care. BioVantage does not guarantee access to any specific treatment, medication or clinical outcome. Any treatment or prescribing decisions are made only following an individual clinical assessment and only where considered clinically appropriate by an authorised healthcare professional.

6. Telehealth Limitations

Telehealth can be convenient, but it is not suitable for every medical issue.

Some conditions require in-person assessment, physical examination, pathology, imaging, urgent care or specialist referral.

If a healthcare professional determines that telehealth is not suitable for your needs, they may decline to provide treatment through BioVantage and may recommend another care pathway.

You acknowledge that telehealth has limitations, including limits on physical examination and reliance on the information you provide.

7. Emergency Medical Disclaimer

BioVantage is not an emergency or urgent-care service. Correspondence received outside operational hours may not be reviewed immediately and should not be used for urgent medical concerns. If you are experiencing a medical emergency, call 000 immediately or attend your nearest hospital emergency department. If you are experiencing a mental health crisis, you may also contact Lifeline on 13 11 14.

8. Bookings And Appointments

Appointments are booked through BioVantage’s online booking system or any other approved booking pathway used by the clinic.

You are responsible for ensuring that your booking details, contact details and health information are accurate.

If you cannot attend your appointment, you must notify BioVantage as soon as possible.

Booking availability may change from time to time.

BioVantage may reschedule, cancel or decline an appointment where reasonably necessary, including where the service is not suitable, a practitioner is unavailable, or further information is required.

9. Fees And Payments

Consultation fees and any applicable charges will be displayed or communicated to you before payment.

Payment may be required before your appointment is confirmed.

BioVantage may use third-party payment providers to process payments securely.

BioVantage is not responsible for delays, errors or outages caused by third-party payment providers, except where required by law.

 

Any additional third-party costs, such as pathology, pharmacy, external provider or follow-up costs, will be separate unless expressly stated otherwise.

10. Refund And Cancellation Policy

Refunds, cancellations and appointment changes are governed by BioVantage’s Refund & Cancellation Policy available on our website.

11. Privacy And Health Information

BioVantage collects, uses, stores and discloses personal information and health information in accordance with its Privacy Policy.

This may include your name, contact details, date of birth, medical history, medications, allergies, health goals, consultation information, payment information, communications and other information needed to provide clinic services.

By using BioVantage’s services, you acknowledge that BioVantage may collect and handle your information for the purpose of providing healthcare services, managing bookings, communicating with you, processing payments, maintaining clinical records and meeting legal and regulatory obligations.

12. Consent Before Booking

Before booking a consultation, patients must provide clear, informed, specific and active consent by manually ticking the relevant boxes to confirm they have read and accepted our Terms & Conditions, Privacy Policy, Refund & Cancellation Policy, and any other notices presented during the booking process. Consent checkboxes must never be pre-ticked. BioVantage maintains secure and retrievable consent records, which may include your name, email, the date and time of consent, specific policy versions, booking and patient IDs, and your IP address where technically available and collected in accordance with applicable privacy requirements.

13. Digital Health Systems, Clinic Software And Telehealth Platforms

BioVantage may use third-party digital health systems to support its services, including clinic management software, online bookings, telehealth consultations, secure forms, payment processing, clinical documentation, electronic prescribing, secure messaging, pharmacy coordination, pathology coordination and reporting.

Where possible, BioVantage will use reputable healthcare technology providers that are selected with consideration of healthcare privacy, security and operational requirements.
BioVantage may use platforms such as Halaxy, Evermed or other approved providers to support bookings, consultation management, clinical records, payment collection, communication and care coordination.

Some third-party platforms may have their own terms, privacy policies, system requirements and technical limitations.

By using BioVantage’s services, you acknowledge that your personal information and health information may be processed through third-party systems where reasonably necessary to provide healthcare services, manage bookings, maintain clinical records, process payments, coordinate care and comply with legal and regulatory obligations.

BioVantage will take reasonable steps to ensure that any third-party system used by the clinic is appropriate for healthcare use, supports secure handling of patient information, and is reviewed from time to time.

14. Pharmacy, Pathology And External Services

Where clinically appropriate, a registered healthcare professional may assist with pathology testing or pharmacy-related coordination where clinically appropriate.

BioVantage does not guarantee that any external service will be required or suitable for you. Please note that prescribing and dispensing remain subject to the independent decisions and legal obligations of the relevant authorised healthcare professional and pharmacy.

External providers operate under their own terms and privacy practices.

BioVantage is not responsible for any issues or clinical decisions made by these independent external providers, except where required by law.

15. Clinical Communication

Our team at BioVantage interacts with you via various channels, including SMS, email, telephone, digital forms, and our secure telehealth or booking platforms. You are expected to monitor these communications regularly and ensure we have your current contact details. Please note that administrative staff are not permitted to offer medical guidance; clinical advice is strictly reserved for qualified healthcare providers. BioVantage does not facilitate emergency support or urgent medical advice through our website, messaging tools, or email services. Prescriptions are only issued where clinically appropriate following assessment by an authorised healthcare professional. The availability of a consultation does not guarantee a prescription or ongoing treatment.

16. Information Security

BioVantage takes reasonable steps to protect personal information and health information from misuse, interference, loss, unauthorised access, modification or disclosure.

BioVantage may use administrative, technical and organisational safeguards, including secure digital systems, access controls, staff responsibilities, privacy-aware processes, backup and recovery processes, and review of technology providers.

No online system can be guaranteed to be completely risk-free. By using BioVantage’s website and digital services, you acknowledge that digital communication and online systems carry some inherent security risks.

Patients are responsible for keeping their own devices, email accounts, login details and contact information secure.

19. User Conduct

You must not misuse the BioVantage website or services.

You must not:

Attempt unauthorised access to any system

BioVantage aims to acknowledge complaints within 2 business days and respond within 10 business days where possible.

Complaints will be reviewed fairly, confidentially and without victimisation.

26. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any dispute will be subject to the jurisdiction of the courts of New South Wales, Australia.

27. Clinical independence 

Healthcare professionals engaged by BioVantage exercise independent professional judgment when assessing patients and making clinical decisions. BioVantage does not direct, influence or interfere with a healthcare professional’s clinical judgment regarding diagnosis, treatment, prescribing or ongoing care.

All clinical decisions are made by the treating healthcare professional based on the individual patient’s circumstances, medical history, clinical assessment and any other information considered relevant. The availability of a BioVantage service or consultation does not guarantee that any particular treatment, medication or prescription will be considered clinically appropriate.

28. Prescriptions and Medication

Prescriptions are only issued where clinically appropriate following an individual assessment by an authorised healthcare professional. Booking, attending or paying for a consultation does not guarantee that a prescription, medication, particular treatment or ongoing treatment will be provided.

Any decision to prescribe, continue, change or discontinue medication is made independently by the treating healthcare professional having regard to the patient’s individual clinical circumstances and applicable professional and legal obligations.

Where a prescription is issued, dispensing is undertaken independently by the relevant pharmacy in accordance with applicable laws, professional requirements and the pharmacy’s own processes. BioVantage does not guarantee the availability, dispensing or supply of any particular medication.
